Doyle Byers

Doyle Byers is a Partner at Johnson Law, PLLC, heading up the firm’s litigation practice.

 

For more than 20 years, clients have looked to Doyle when faced with complex legal disputes and issues that require sound legal analysis and effective advocacy skills. Doyle has extensive commercial litigation, receivership and bankruptcy experience, gained at large regional law firms. His clients range from large international companies to local businesses whom he advises on business, stakeholder, intellectual property and contract disputes as well as antitrust and construction litigation. In the bankruptcy realm, Doyle has represented purchasers, creditors, debtors and trustees in various matters including prosecuting and defending involuntary bankruptcy proceedings, the sale of bankruptcy assets, preference claims and insolvency workout negotiations. In addition to Doyle’s courtroom and dispute resolution experience, Doyle has served as outside general counsel to many small and midsized businesses, advising them on a variety of internal legal matters including employment matters .

 

Representative Experience:

 

Commercial Litigation

  • Represented large venture capital firm in bringing claims for breaches of fiduciary duties, fraud and conversion leading to favorable settlement for client

  • Defended Fortune 500 company against environmental claims at one of its large facilities

  • Defended international shipping company in two-week jury trial for breach of contract for over $50 million in claims

  • Defended construction companies on construction defect claims and multiple contract disputes

  • Represented major oil company in multi-district antitrust litigation against insurance industry

  • Represented electric utility in two-week arbitration for long term power contracts with claims in excess of $300 million

  • Represented marketing company in various distributor disputes

  • Represented commercial airline leasing company in successful repossession of multiple commercial aircraft obtaining judgement and sanctions in excess of $30 million; including successful defense of two appeals at the Ninth Circuit Receivership

Bankruptcy and Insolvency

  • Represent Receiver in SEC enforcement action in largest alleged Ponzi scheme in Utah history, including liquidating and administering the receivership estate that resulted in 100% principal return to investors; investigating and prosecuting claims for fraud, fraudulent transfer, and insider transactions; and prevailing in four separate trials regarding claims.

  • Represented creditor pursuing claims for fraudulent transfer that resulted in unanimous jury verdict in favor of client

  • Defended multiple creditors against preference and fraudulent transfer claims

  • Represented various creditor groups in prosecuting involuntary bankruptcy claims

  • Represented numerous clients in the negotiation of sales and purchases of bankruptcy assets

  • Defended motion picture studio against involuntary bankruptcy proceedings

Intellectual Property

  • Successfully defended client in $200 million trade secret litigation

  • Represented large construction company pursuing patent infringement claims

  • Defended marketing company against claims of misappropriation of trade secrets and violation of non-solicitation agreement
